The Disability Equality Duty

The General Duty to promote disability equality and eliminate disability discrimination will come into force on 5th December 2006. The Duty enhances existing legislation and does not create new rights for disabled people. The specific duty regulations came into force on 5th December 2005. The specific duty contains an obligation for public authorities to publish a disability equality scheme no later than 4th December 2006.

Local authorities and further and higher education institutions are covered by the Act. The scheme may be included in another document or plan e.g. development plan.

From December 2006, all public authorities will be required to actively promote disability equality. The definition of disability is that used by the Disability Discrimination Act. This is similar to the duty public authorities have under the Race Relations Amendment Act (2000) to promote race equality.
